TERMS OF USE

INTRODUCTION

We present to you (“User”) the Terms and Conditions of Use (“Terms”), which outline the main rules to be observed by everyone accessing the Digital Channels of QORE (“Digital Channels”), as well as some instructions for using QORE services, which will help you utilize them.

The purpose of these Terms is to establish rules regarding the handling of personal data, within the scope of the services and functionalities of the Digital Channels offered, in addition to the recording of activities in accordance with applicable laws in force, with transparency and clarity towards the User and the market in general.

As a condition for accessing and using the exclusive functionalities of our Digital Channels, the User declares that, by accepting them or by using the services of QORE willingly and voluntarily, they have read this entire Terms carefully and attentively, being fully aware of all its provisions as well as the other policies incorporated into these Terms by reference, thus giving their free and express consent to the rules set forth herein.

To access some of the functionalities available, the User must first register. Only one registration is permitted with the Digital Channels of QORE. If more than one registration is identified for the same User, one or all of these registrations may be suspended or canceled without imposing any penalties on QORE.

When the registration is of a natural person, the User must be at least 14 (fourteen) years old and, if under 18 (eighteen) years old, must be assisted by parents or legal guardians, who shall be responsible for any and all actions taken by minors when using the Digital Channels. In the case of a legal entity registration, the User must be the legal representative of the Company or have the authority to represent it before QORE.

The User who already has their CPF registered as a natural person may also use their login for the registration of a legal entity and may be associated with more than one CNPJ. The natural person User whose login is linked to the registration of a legal entity will have access to payment statements, and transaction statements, requests for services related to the legal entity, among other functionalities.

To unlink a natural person User’s login from the registration of a legal entity, the responsible party for the legal entity must contact via email at lgpd@qoredtvm.com.br to request the deletion of that User’s registration.

The registration of the User is conditioned upon the provision of their personal and registration data directly on the Digital Channels. To optimize the User experience, QORE may use authentication applications (“login”) provided by social media, such as, but not limited to, Facebook Connect or Google Sign-In.

QORE may refuse or not approve registration requests made by Users who do not provide the data correctly.

QORE reserves the right to refuse to grant, suspend, or cancel the Access Account of any User who uses it in a fraudulent, incorrect, outdated, or incomplete manner, violates or attempts to violate these Terms or any document of QORE made available on our Digital Channels. This provision also extends to cases where QORE has sufficient reasons to suspect that such information is false, incorrect, outdated, or incomplete. The suspension or cancellation of services does not depend on prior notification by QORE to the User.

QORE may change the eligibility criteria for access and use of the Digital Channels at any time; therefore, the User should frequently check the updated Terms on the QORE website.

SECURITY

The Digital Channels use protective barriers and security procedures to safeguard their assets in order to prevent any misuse or unauthorized alteration of the data held by them.

The provision and submission of data are the responsibility of the User. Only after the collection of data will QORE be able to apply its security controls and preserve its privacy.

QORE adopts various security mechanisms to ensure access to User data, among them the respective access password.

Access to the transactional areas of the Digital Channels is made through the use of a login and password, created directly by the User according to the security requirements indicated by QORE at the time of registration. Thus, the password is the credential for accessing the Digital Channels, being rigorously defined and managed by the User, and it is for individual and non-transferable use.

RESPONSIBILITIES AND OBLIGATIONS OF USERS

Users are responsible and agree to:

  • Use the Digital Channels provided by QORE correctly, in accordance with the law and ethical principles, respecting the conditions governing their use and purpose;
  • Provide their registration data accurately, completely, and updated, in addition to informing the contact channel capable of being activated by QORE, for better fulfillment of its services, either by themselves or through their employer.
  • Maintain the confidentiality of access data to their Access Account, especially their login and password, in relation to third parties and use it individually and nontransferable.

Failure to comply with any of the obligations stipulated herein may result in the total or partial suspension of functionalities in the Digital Channels or the exclusion of the Access Account, without prior notice, as provided in these Terms.

RESPONSIBILITY AND OBLIGATIONS OF QORE

The Digital Channels and their functionalities are presented to Users as they are available, and may undergo constant improvements and updates, with QORE undertaking to:

  • Preserve their functionality, with no broken links and using layouts that respect usability and navigability whenever possible;
  • Display the functionalities clearly, completely, accurately, and sufficiently so that there is an exact perception of the operations performed;
  • Protect, through the available state of the art, the data collected by the functionalities provided.

QORE makes every effort to maintain the continuous and permanent availability of our Digital Channels. However, there may occasionally be temporary unavailability due to necessary maintenance or even caused by force majeure, such as natural disasters, failures in communication systems, internet access, or actions of third parties that are beyond its sphere of oversight and responsibility.

If this occurs, QORE will do what is within its power to restore access to the Digital Channels as soon as possible, within the technical limitations of its services and the third-party services upon which it relies to remain online.

QORE may, according to its business objectives, modify or discontinue (temporarily or permanently) the distribution or update of our DIGITAL CHANNELS.

EXEMPTION AND LIMITATIONS OF LIABILITY OF QORE

QORE is not responsible for:

  • Any problems, bugs, glitches, or improper operations that occur on USERS’ devices and equipment as a result, directly or indirectly, of the regular use of our Digital Channels;
  • Any direct or indirect damage caused by events from third parties, including but not limited to hacker attacks, system failures, server issues, or internet connection problems;
  • Users’ navigation on external links provided in the Digital Channels, as the use of such links is at the User’s discretion.

THIRD-PARTY APPLICATIONS

Our Digital Channels may contain links or frames to third-party websites and/or applications, which may or may not be partners of QORE. For more information, please refer to QORE’s Privacy Policy. These third-party applications are provided solely to offer an additional benefit and convenience for the User.

GENERAL PROVISIONS

User support may be provided through the customer service channels available on each of the Digital Channels.

Users may also use the customer service channels whenever they encounter or verify inappropriate content on the Digital Channels.

APPLICABLE LAW AND JURISDICTION

This Policy will be governed, interpreted, and enforced according to Brazilian law, in the Portuguese language, with the Forum of the User’s domicile elected to resolve any disputes or controversies involving this document.
